GENERAL TERMS AND CONDITIONS FOR CONTRACTING AND USING UNDER LOCK VALENCIA

OBJECT

These general terms and conditions govern the hiring of UNDER LOCK VALENCIA lockers (owned by Lockers Low Cost Valencia, OESPJ) at its establishment locate on Calle Segorbe, 8 bajo izquierda, 46004 Valencia, through the website www.underlock.es and their use. Additionally, these conditions regulate the contractual relationship between Lockers Low Cost Valencia, OESPJ (owner of UNDER LOCK VALENCIA lockers) and the User who hires the UNDER LOCK VALENCIA service.

OUR LOCKERS

UNDER LOCK VALENCIA offers its Users the option to rent any of its lockers for periods of natural days (from 08:00 to 22:30h)

UNDER LOCK VALENCIA provides lockers in 3 sizes and 3 different prices (VAT included):

- Medium Lockers (M): Dimensions are 37 cm (height) x 48 cm (width) x 58 cm (depth). Price: €8/day (from 08:00 to 22:30h)

- Large Lockers (L): Dimensions are 46 cm (height) x 48 cm (width) x 58 cm (depth). Price: €12/day (from 08:00 to 22:30h)

- Extra-Large Lockers (XL): Dimensions are 85 cm (height) x 48 cm (width) x 58 cm (depth). Price: €16/day (from 08:00 to 22:30h)

Users may store their items in these lockers as long as they do not violate the Usage Limits. Lockers can be rented for a minimum of 1 day (from 08:00 to 22:30h).

During this period, the user may access their belongings as many times as needed (from 08:00 to 22:30h).

For longer than 3 days, the user must contact us and explain the reasons at info@underlock.es otherwise, their belongings will be kept for a máximum of one week. After this time, they will either be disposed of.

PRICE

The prices applicable to each type of locker are those indicated on the website at the time of the order. All prices on the website include VAT (Value Added Tax) and correspond to the rental of a locker for 1 natural day (from 08:00 to 22:30h).

Offers will be clearly marked and identified as such, indicating both the previous price and the offer price.

UNDER LOCK VALENCIA may make changes as deemed necessary at any time, based on its needs and market conditions.

OPERATION

To rent UNDER LOCK VALENCIA, the following requirements must be met:

1. Having reached or being over 16 years of age.

2. Accurately fill in the fields indicated in the reservation form on the RESERVATIONS section of the website (including the following information: name, surname, phone number, email, reservation date, rental days, number of lockers desired (indicating size), and payment details according to the chosen payment method).

3. Accept these general terms and conditions for the service and locker use.

4. Accept the privacy policy of Lockers Low Cost Valencia, OESPJ, Lockers Low Cost Valencia, OESPJ as the entity owning UNDER LOCK VALENCIA.

At UNDER LOCK VALENCIA, we have smart lockers where the entire reservation and usage process is handled automatically.

Users can make reservations through our website www.underlockvalencia.es, providing their personal details, the number of lockers desired, their size, and the reservation period.

Users make secure payments through credit card.

From the site underlock.es, an email is sent to the address provided by the user, confirming the reservation, the number of lockers reserved, and an access code to the facility and locker opening.

MODIFICATION, CANCELLATION AND REFUND OF SERVICES

In bookings made at our premises, it will only be posible to cancel or modify the rental if payment has not been made.

INCIDENT MANAGEMENT

In case of breakdown, blockage or any other type of incident in the use of the locker, the User will have at their disposal the assitance service of UNDER LOCK VALENCIA by calling the telephone number +34 618142514 during business hours from 09:00 to 21:00 or by written communication to the following address: info@underlock.es.

Outside of the indicated hours, communication through either of the two channels is not considered.

RESERVATION FORM

The reservation form on the website www.underlock.es that the User must complete contains the data required by LOCKERS LOW COST VALENCIA, OESPJ to formalize the rental of UNDER LOCK VALENCIA lockers and to meet the contractual obligations arising from the locker service the User has contracted.

The User guarantees that all data about their identity and the reservation details are true, accurate, and complete.

Personal data provided will be used to manage the reservation and fulfill the obligations arising from the locker service. LOCKERS LOW COST VALENCIA, OESPJ is authorized to process the personal data provided during the contracting process as necessary for service provision. The User, by contracting, expressly consents to the processing of their personal data as detailed here.

USER OBLIGATIONS

Use lockers only as a temporary storage place for their own property. Use lockers correctly, without causing damage to them, and ensure that the locker is closed when the user leaves the premises. This implies the commitment to use lockers for legal and authorized purposes, undertaking not to store objects whose mere possession or trafficking is ilegal (stolen objects, drugs, etc.).

Likewise, do not introduce flammable, polluting, or hazardous materials into the lockers; neither animals nor living beings.

If any material deposited in the lockers requires a permit or license for its possession, have that license.

Do not introduce unpackaged food or drink.

Do not include money, jewelry, technological ítems (tablets, computers, televisions, etc.) or ítems of special value in the lockers, the decision of the user to use the rented lockers to store such ítems of special value is solely and exclusively their responsibility.

Remove the ítems placed in the rented lockers before the end of the rental period, i.e., before the period end (22:30h). If not done, the user must pay corresponding fee for the time slot to open their locker, the mínimum rental perios is 1 day and the Access to the premises is from 08:00 to 22:30h.

Leave the lockers at the end of the service in the same condition as they were found. Notify UNDER LOCK VALENCIA of any issues with the lockers or their condition through info@underlock.es.

IMPORTANT

Do not exceed the marked line inside the lockers when storing luggage.

Do not force the door when closing the locker, it could block the door, preventing it from opening.

Do not share the access code with third parties; the User is responsible for any breach of these obligations. Do not use the lockers for exchanging goods with third parties.

Access the premises only to access the lockers, without staying in the premises longer than strictly necessary.

Do not take photos or recordings of the security mechanisms of the premises.

CONSEQUENCES AND RESPONSIBILITY OF THE USER IN THE EVENT OF NON-COMPLIANCE WITH ITS OBLIGATIONS

The User must hold LOCKERS LOW COST VALENCIA, OESPJ harmless for any damages arising from non-compliance with its obligations arising from this contract.

Failure to comply with the rental period

In the event that the rental period is not met, UNDER LOCK VALENCIA may empty the user's lockers to manage the destruction of the packages. The deadlines for this management will be the following: If 7 days after concluding the rental period the user has not contacted, it will be understood that the goods have been abandoned by the user, so UNDER LOCK VALENCIA may stop keeping them, giving them the exit that it considers appropriate or convenient depending on the type of abandoned property or destroy them.

The amount that the user will have to pay to LOCKERS LOW COST VALENCIA, OESPJ for each day that passes since the rental expires, without having released the lockers, will be the equivalent of the price of the locker for that period plus a penalty of €150. regardless of the right of LOCKERS LOW COST VALENCIA, OESPJ to claim damages actually suffered. In the event that the user is contacted and their belongings have to be returned, a penalty of €150 will be accrued that the User must pay to LOCKERS LOW COST VALENCIA, OESPJ, regardless of the right of LOCKERS LOW COST VALENCIA, OESPJ to claim the damages and losses suffered. At the time LOCKERS LOW COST VALENCIA, OESPJ delivers the packages to the carrier, the responsibility will be the user, and LOCKERS LOW COST VALENCIA, OESPJ does not assume any risk for the transportation of the packages.

Failure to properly use the instructions

LOCKERS LOW COST VALENCIA, OESPJ reserves the right to remove any object that does not comply with the regulations for the use of lockers and is a prohibited object. If necessary, LOCKERS LOW COST VALENCIA, OESPJ will be authorized to call the police and report acts that it considers criminal, as well as allow prohibited objects to be removed.

The User will be responsible for the objects that he introduces in the lockers.

In any case, the removal of prohibited packages will entail a penalty of €150, a penalty that will not exclude the obligation of the non-compliant User to compensate LOCKERS LOW COST VALENCIA, OESPJ for the damages actually caused.

If the user exceeds the marked line inside the lockers when storing their belongings, the locker door may be blocked and cannot be opened when collecting the luggage. If this occurs, the user can contact us and we will attend to their incident. The cost of this management/assistance will be €30.

Payment of penalties

The penalties detailed in this section will be paid by the User with the same payment method as that used by the User when contracting the service or by the means that at that time is considered most appropriate by LOCKERS LOW COST VALENCIA, OESPJ.

Damage caused to the lockers by Users

The User will be fully responsible for any damage or deterioration that may be caused to the lockers due to improper or inappropriate use. If applicable, the User must compensate LOCKERS LOW COST VALENCIA, OESPJ for the physical damage caused to the locker(s) as well as for lost profits.

In particular and without limitation, the User causing the damage must pay LOCKERS LOW COST VALENCIA, OESPJ a daily rental penalty per day in which the locker is unusable, as well as the cost of repair or replacement, which is quantified in the event of replacement at €1,500, all regardless of the damages caused.

OBLIGATIONS OF LOCKERS LOW COST VALENCIA, OESPJ

LOCKERS LOW COST VALENCIA, OESPJ is obliged to keep the lockers service active and to make available to the User, during the contracted time, the lockers or lockers that the User has contracted in good condition of use.

Likewise, LOCKERS LOW COST VALENCIA, OESPJ undertakes to resolve any incident that may arise in the use of the lockers as soon as possible.

LIMIT OF LIABILITY OF LOCKERS LOW COST VALENCIA, OESPJ AND INSURANCE

LOCKERS LOW COST VALENCIA, OESPJ offers a space rental service in lockers, and is not responsible for the custody of the packages. The User is solely responsible for the goods included in the rented lockers.

The user, if necessary, must file a report with the competent authorities in case of theft.

Notwithstanding the above, in the case of theft, LOCKERS LOW COST VALENCIA, OESPJ has signed an insurance contract in favor of users that covers losses due to theft up to a maximum amount. To receive this benefit should it occur, the user must meet the requirements listed in the policy and collaborate with UNDER LOCK VALENCIA to submit the claim to the insurer. The user must in any case file a theft report with the competent authorities. This insurance does not cover the loss of money, jewelry, precious stones or metals, watches, plasma screens and in general technological elements (LCD, GPS navigators, cell phones, computers, tablets), art objects, antiques, memory cards or any other media containing data or images.

CLAIMS

If the User considers that they have grounds to file a complaint, they may do so by sending an email to the following address info@underlock.es.

At LOCKERS LOW COST VALENCIA, OESPJ we will try to solve the incident and find a satisfactory solution for the parties.

In the event that the User is not satisfied with the response from LOCKERS LOW COST VALENCIA, OESPJ has the option of submitting a complaint form to the consumer authorities of the Valencian Community. APPLICABLE LAW AND JURISDICTION

These General Conditions are governed by Spanish Law. The parties submit to Spanish jurisdiction to resolve any controversy that may arise in relation to this Contract.
